- Introduction
This Refund & Cancellation Policy (“Policy”) governs all matters relating to lesson cancellations, rescheduling, missed lessons, refunds, partial refunds, unused lesson credits, and payment disputes concerning the online language learning services provided by Cirellum Limited (“Cirellum”, “we”, “our”, “us”) through https://cirellum.com
(the “Website”). This Policy forms an integral and binding part of our Terms & Conditions and must be read in conjunction with our Privacy Policy, Payment / Billing Policy, Cookies Policy, and Disclaimer.
By purchasing lesson packages, booking individual lessons, or otherwise using our services, you expressly acknowledge and agree to be bound by this Policy. If you do not agree, you must refrain from purchasing or booking lessons.
- Nature of Services and Digital Service Acknowledgment
Cirellum provides digital services delivered online in real time through remote communication platforms. By completing a purchase, you expressly acknowledge that the services constitute digital services supplied at your request and that performance may begin before the expiration of any applicable statutory withdrawal period under EU consumer law. Where you schedule and attend lessons within any applicable cooling-off period, you expressly consent to the commencement of performance and acknowledge that you may lose your statutory right of withdrawal in relation to services already provided.
Nothing in this Policy is intended to limit non-excludable consumer rights under applicable law; however, where permitted by law, refund rights may be limited once service delivery has commenced.
- Booking Confirmation and Responsibility
A lesson booking becomes confirmed once payment has been successfully processed and confirmation has been issued through our system. It is your responsibility to review booking details, including date, time, and time zone, immediately upon receipt of confirmation. Cirellum shall not be liable for errors arising from incorrect booking information that was not promptly reported.
All scheduled lesson times are binding once confirmed and subject to this Policy.
- Student-Initiated Cancellations and Rescheduling
Students may cancel or request rescheduling of a confirmed lesson provided that notice is given no later than twenty-four (24) hours before the scheduled lesson start time. Where such notice is provided within the required timeframe, the lesson may be rescheduled or credited back to the student’s active lesson balance without penalty.
Where cancellation occurs less than twenty-four (24) hours before the scheduled lesson start time, such cancellation shall be deemed a late cancellation. In cases of late cancellation, Cirellum reserves the right to deduct the lesson from the student’s package and no refund shall be issued for that lesson. The reserved tutor time, administrative coordination, and scheduling commitments justify this policy.
Repeated late cancellations may result in restrictions on booking privileges at our discretion.
- Failure to Attend (No-Show)
Failure to attend a scheduled lesson without prior cancellation within the permitted timeframe shall constitute a “No-Show.” In the event of a No-Show, the lesson shall be marked as completed, deducted from the student’s package, and no refund or credit shall be issued.
Cirellum is not responsible for missed lessons due to incorrect calendar entries, time zone misunderstandings, forgotten appointments, or technical issues on the student’s side. Students are solely responsible for ensuring timely attendance.
- Tutor Cancellations
If a tutor is unable to deliver a scheduled lesson due to illness, emergency, technical failure, or other unforeseen circumstances, Cirellum will make reasonable efforts to reschedule the lesson at a mutually convenient time or re-credit the lesson to the student’s package. Where rescheduling within a reasonable timeframe is not possible, Cirellum may issue a proportional refund corresponding to the affected lesson.
Tutor substitutions or rescheduling due to operational needs shall not constitute breach of contract and do not automatically entitle the student to compensation beyond rescheduling or credit of the missed lesson.
- Technical Disruptions
Students are responsible for maintaining adequate internet connectivity, functioning audio and video equipment, and access to required software platforms. Lessons disrupted or rendered inaccessible due to technical issues originating from the student’s equipment, internet service, firewall restrictions, or device malfunction shall not qualify for refund.
Where substantial disruption is clearly attributable to Cirellum or the tutor and materially prevents lesson delivery, we may, at our sole discretion, offer rescheduling or credit. Minor connectivity interruptions that do not prevent substantial delivery of instruction shall not qualify for refund.
- Refunds for Lesson Packages
Refund requests for unused lessons in purchased packages must be submitted in writing to our support contact. Approval of refunds for unused lessons is subject to administrative review and compliance with this Policy.
Where a lesson package was purchased at a discounted or promotional rate and a partial refund is requested, Cirellum reserves the right to recalculate the value of completed lessons at the standard single-lesson rate before determining the refundable balance. Administrative fees and non-refundable third-party payment processing fees may be deducted where legally permissible.
No refunds shall be issued for lessons that have already been delivered, except where required by applicable law or where Cirellum determines that the lesson was not provided in accordance with agreed standards.
Dissatisfaction based solely on subjective expectations regarding learning speed, teaching style, or personal progress does not automatically entitle a student to a refund.
- Cooling-Off Period under EU Law
Where EU consumer protection law applies, consumers may have a fourteen (14) day withdrawal right for distance contracts. However, by purchasing lesson packages and scheduling lessons to begin within this period, you expressly request that Cirellum commence performance immediately. Once a lesson has been delivered during the statutory withdrawal period, you acknowledge that your right of withdrawal is lost in respect of the services already performed.
If no lessons have been scheduled or delivered and a valid withdrawal request is submitted within the statutory timeframe, a refund may be issued in accordance with applicable law.
- Payment Disputes and Chargebacks
Initiating a chargeback, payment reversal, or dispute through your bank or payment provider without first contacting Cirellum to resolve the matter may result in immediate suspension of your account and denial of access to future services.
Where a chargeback is determined to be unjustified and services were properly delivered in accordance with this Policy, Cirellum reserves the right to pursue recovery of the disputed amount and any associated administrative costs to the extent permitted by law.
We strongly encourage users to contact us directly to resolve any concerns prior to initiating payment disputes.
- Exceptional Circumstances
Cirellum may, at its sole and absolute discretion, consider exceptions to this Policy in cases involving documented medical emergencies, serious unforeseen events, or force majeure circumstances. Granting an exception in one case does not create a precedent or obligation to grant similar exceptions in future cases.
- Termination and Refund Eligibility
If access to services is terminated due to violation of the Terms & Conditions, including misconduct, abuse, harassment, or attempts to circumvent payment systems, Cirellum reserves the right to deny refunds for unused lessons. Protection of tutors, staff, and platform integrity remains a priority.
- Amendments to This Policy
Cirellum reserves the right to amend or update this Refund & Cancellation Policy at any time to reflect operational, legal, or regulatory changes. Updated versions will be published on the Website with a revised “Last Updated” date. Continued use of our services after such publication constitutes acceptance of the revised Policy.
